GCC Privacy Laws Overview

The Gulf Cooperation Council (GCC) countries are rapidly developing and strengthening their data privacy frameworks, driven by digital transformation initiatives, economic diversification goals, and the need to facilitate international data flows. Saudi Arabia leads with the PDPL (2021), the most comprehensive privacy law in the region. The UAE followed with the federal PDPA (2021) complementing existing free zone regulations in the DIFC and ADGM. Bahrain enacted the Personal Data Protection Law (PDPL, Law No. 30 of 2018), one of the first comprehensive data protection laws in the GCC, overseen by the Ministry of Industry, Commerce, and Tourism. Kuwait's Constitution provides privacy protections, and sector-specific regulations govern data handling in telecommunications and banking, though a comprehensive data protection law is still under development. Oman issued the Personal Data Protection Law (Royal Decree 6/2022), establishing requirements for consent, data subject rights, cross-border transfers, and breach notification, with the Ministry of Transport, Communications, and IT as the supervisory authority. Qatar's Personal Data Privacy Protection Law (Law No. 13 of 2016) applies to both public and private sectors and is supplemented by the Qatar Financial Centre Data Protection Regulations. Across the GCC, common themes include consent-based processing, data subject rights (access, correction, deletion), cross-border transfer restrictions, breach notification obligations, and increasing penalties for non-compliance.
